Summary of Proposed Conditions
For the portion of the property being rezoned RX-:
- Uses that are currently permitted in the RX- District shall be prohibited: boardinghouse; dormitory, fraternity, sorority; Emergency Shelter type B.
- No more than 400 dwelling units.
- Any portion of a building within 100′ of 1605, 1607, 1609, 1613, or 1621 Bruce
Circle shall not exceed three stories and 50′ in height.
If more than 100 units are developed, the developer will install a traffic signal at the intersection of Tryon Road and Fairway Drive if permitted by NCDOT.
- A stub for future cross-access will be provided for the property at 1526 Tryon
Road - Two percent of the dwelling units will be affordable for households earning sixty
percent area median income.

Approximately 43.83 acres are requested to be rezoned by Toby Coleman of Smith Anderson on behalf of Raleigh Leased Housing Associates I, LLLP. The site is within Raleigh city limits. Proposed conditions for the portion of the property being rezoned RX- would prohibit uses that are currently permitted in the RX- district, such as boardinghouse, dormitory, fraternity, sorority, and Emergency Shelter type B; limit the number of dwelling units to 400; limit the height for buildings within 100′ of 1605, 1607, 1609, 1613, and 1621 Bruce Circle to three stories or 50′; state that if more than 100 dwelling units are developed, the developer will install a traffic signal at the intersection of Tryon Road and Fairway Drive if permitted by NCDOT; state that a stub for future cross-access will be provided for the property located at 1526 Tryon Road; and stipulate that two percent (2%) of the dwelling units will be affordable for households earning sixty percent (60%) of the area median income (AMI).
The request last appeared on the June 10, 2025, Planning Commission agenda under Old Business. At the meeting on May 27, 2025, the Planning Commission received a full staff presentation of the rezoning request followed by an applicant presentation. The Planning Commission voted to defer a decision on the request to the June 10, 2025, meeting. At that meeting, the Planning Commission did not have a quorum, and the case was deferred to the June 24, 2025, meeting. Since the May 27, 2025, meeting, the applicant submitted a revised application that changed the requested district for part of the site from RX-4-CU to R-10-CU. The revisions also made amendments to the zoning conditions.
The request is inconsistent with the Future Land Use Map. The request is consistent with the 2030 Comprehensive Plan.

2. TC-2-25: Stormwater Items to Reflect State Law

This text change amends the Unified Development Ordinance to (1) exempt properties over one acre with one 1-or 2-unit dwelling from the full stormwater requirements if their limits of disturbance are less than one acre and (2) adopt the State’s definition of built-upon area. Adoption of TC-2-2025 would: Allow one 1- or 2-unit dwellingon parcels over one acre to avoid the full stormwater regulations when the project limits of disturbance are oneacre or less. They would instead be subject to zoning-based impervious area limits. Change the definition of built-upon area, which is the State’s term for impervious area. Slatted decks, certain gravel installations, and artificialturf over pervious land would be considered 0% built-upon area.

The proposal is for a community of Tiny Homes. Several neighbors of Biltmore Hills are in opposition since Tiny Homes styles are not consistent with the style of neighboring single-family homes. It may reduce the value of existing neighborhood homes. The PC requested further consideration for consistency with the neighborhood.
Action: Deferred for additional conditions until August 26.

The request is consistent with the 2030 Comprehensive Plan overall. The RHDC recommends approval (8-0).
Family-owned business requesting zoning change for future leasing opportunities and legacy family uses. Note that Tolulope Omokaiye urged owners to consider additional conditions. They refused due to the probable cost involved.

Approximately 14.10 acres are requested to be rezoned by Chad Essick of Poyner Spruill on behalf of Wake Cross Roads Baptist Church. The applicant proposes one zoning condition, which would limit the site’s maximum entitlement to either 325 residential units, 115,000 square feet of office or medical space, or 57,500 square feet of retail space, along with various combined scenarios in between.
The request is consistent with the Future Land Use Map.
The request is consistent with the 2030 Comprehensive Plan.
Note that PC went beyond standard time. Check for quorum if meeting extended. Three Commissioners did not stay but still had quorum.
Comment: One of the oldest Baptist churches in Wake County. Need to change zoning to get better property corner frontage.

Approximately 2.66 acres are requested to be rezoned by Worth Mills of Longleaf Law Partners, on behalf ofVibes Fund LLC. Proposed conditions would prohibit certain uses otherwise allowed in R-10 like congregate,continuing, and retirement communities, rest homes, K-12 schools, day care centers, golf courses, outdoor sports facilities, and parking facilities. Conditions also prohibit the apartment building type, increase theminimum side yard and rear yard setbacks to 10′ and 30′, respectively for properties located at 8037 GhostPony Trail and 8040 Ghost Pony Trail, and will install a wall of at least 6′ in height and 4 understory trees per100’ along the southern boundary of the site.
The request is consistent with the Future Land Use Map.
The request is consistent with the 2030 Comprehensive Plan.
Several residents opposed. They do not want townhomes in the middle of single-family neighborhoods. The major concern is added traffic in surrounding neighborhoods. Additional road connectivity to Leesville Road increasing traffic is another major factor.

Note that Blannie Miller (current chair) rotates off the Planning Commission in the fall.
The Planning Commission shall elect a Chairperson and Vice Chairperson in June each year. These officers shallserve a one-year term and will continue to serve until a successor has been selected by the Commission.
The Chairperson shall preside over all regular meetings of the Planning Commission. The Chairperson shall appointthe members of the regular subcommittees.
The Vice Chairperson shall serve as Chairperson at a meeting in the event of absence or abstention of theChairperson. The Vice Chairperson shall serve as the Chairperson of the Committee of the Whole.
