Approximately 37.9 acres are requested to be rezoned by Jamie Schwedler, Parker Poe, on behalf of Brier Creek Corporate Center Master Association, Inc. c/o American Asset Corporation; Brier Creek Corporate LLC c/o American Asset Corporation; Brier Creek Apartments LLC & WF Brier Creek Member LLC; and CMC MACAW LLC c/o Shahn Chhabra. The request would rezone nine properties from Planned Development with Special Highway Overlay District-2 and Airport Overlay District (PD w/ SHOD-2 and AOD) to PD, keeping the corridor overlay and removing the airport overlay (PD w/ SHOD-2). The rezoning site is the Brier Creek Town Center. Two of the nine parcels subject to this rezoning are built out with residential and commercial uses, including apartments, restaurants, and a hotel.

The Planned Development district is a customized zoning district that requires submittal of an associated Master Plan. The Brier Creek Town Center PD Master Plan proposes three tracts which provide the framework for separation of height maximums, square footage maximums, intended uses, and development intensities. The Master Plan proposes clarifications and modifications to UDO standards including building setbacks; lot dimensions; vehicular access; streetscape; sidewalks; and use regulations. The request would prohibit office uses; decrease the amount of non-residential square footage that could be built; and increase the number of residential and hotel units that could be built. It would continue to allow for building heights up to 195’. The Planned Development Master Plan is included in the back up materials.
