Board of Adjustment

The City of Raleigh Board of Adjustment will conduct a public meeting on Monday, January 12, 2026 at 1 p.m. in the City Council Chamber at the Raleigh Municipal Building, 222 West Hargett Street.

BOA-0039-2025  Whereas Karen Pirozzi and David Guistina, property owners, request a 78’ variance from UDO Section 2.6.3.H.1 to allow an accessory dwelling unit to be placed 78’ in front of the front wall of the house on a .46-acre property zoned Residential-4 and located at 6809 Sandy Forks Road. This case is DEFERRED/PENDING: Not to be discussed at this meeting.
BOA-0049-2025 Whereas Linda B. Alphin, property owner, requests i) a 1.9’ variance from the required 2.5’ driveway and parking setback pursuant to UDO Section 2.2.7.F in order to accommodate a proposed driveway expansion; and ii) a variance for complete relief from the 2.5’ separation requirement from fences and walls from driveways pursuant to UDO Section 2.2.7.F in order to relocate an existing retaining wall along the western edge of the proposed driveway , in association with a proposed driveway expansion located on a 0.2-acre parcel zoned Residential-6 and Special Residential Parking Overlay District (-SRPOD) and located at 2510 Stafford Avenue.
BOA-0045-2025 Whereas Preiss Powell Development VII LLC, property owner, requests: (i) a 2’ variance to UDO Section 7.2.8.B.9., which requires a fence within a side or rear setback to be no more than 8’ in height, in order to construct 10’ high fence along the western and southern property boundaries with up to 100% opacity; (ii) a 3.5’ variance to UDO Section 7.2.8.B.8., which requires a fence within a front or side street setback to be no more than 6.5’ in height, in order to construct a 10’ high fence within the Reavis Road setback with up to 100% opacity; (iii) a 9% variance to UDO Section 9.2.2.A.4., which sets a maximum of 65% impervious surface for the R-10 zoning district, in order to develop proposed Lot 1 with 74% of impervious surface; and (iv) complete relief to UDO Section 7.2.8.B.7., which requires breaks in a fence every 100’, in order to construct a continuous fence along the northern, southern, and western Property boundaries. The requests are made in connection with a proposed subdivision of 4 attached homes on a 0.91-acre parcel zoned R-10, Special Residential Parking Overlay District and Transit Overlay District and located at 4101 Reavis Road.
BOA-0053-2025 Whereas, Andrew and Lucy Brown, property owners, request an 8’ rear setback variance from UDO Section 2.2.1.B4 to construct a rear addition to an existing detached house, resulting in a 12’ rear setback on a .19-acre property zoned Residential-10 and Neighborhood Conservation Overlay District (Five Points East (Core)) and located at 200 Duncan Street.
BOA-0054-2025 Whereas, Redeeming Love Missionary Baptist Church, property owner, requests a 6’ variance to UDO Section 7.3.8.B to allow a 9.5’ low profile ground sign on a 7.95-acre property zoned Residential-6 and Special Highway Overlay District-1 and located at 3425 Rock Quarry Road.
