Whereas Chester Road Investors, LLC, property owner requests:(i) a variance for complete relief to the required 6’ wide sidewalk of UDO Section 8.5.4.C., in order to not construct a sidewalk along Grant Avenue; and (ii) a variance for complete relief from the required street tree plantings of UDO Section 8.5.4.C., which requires five (5) street trees along Grant Avenue, in order to preserve the two (2) existing maple trees along Grant Avenue, in association with a 7-unit townhouse project proposed on a property totaling .5-acre zoned Residential-6 and located at 2308 Grant Avenue and 1401 Chester Road.

Whereas Louise and Joey Thompson, property owners, request a variance for 520 square foot of relief from the 1000 square foot maximum combined floor area allowed for accessory structures set forth in UDO section 6.7.2.E1 to allow for the addition of a 714 square foot detached garage on a .47-acre property zoned Residential-4 and Special Residential Parking Overlay District and located at 2713 Crestline Avenue.

Whereas Karen Pirozzi and David Guistina, property owners, request a 78’ variance from UDO Section 2.6.3.H.1 to allow an accessory dwelling unit to be placed 78’ in front of the front wall of the house on a .46-acre property zoned Residential-4 and located at 6809 Sandy Forks Road.

Whereas, 1893, LLC, appeals the Notice of Violation issued on July 2, 2025 and any and all administrative decisions contained therein, to the owners of 516 N. Blount Street concerning the property’s unpermitted land uses on a .37-acre parcel zoned Office-Mixed-Use-3-Detached and Historic Overlay District-General.
Whereas Carl Schaffner, property owner, requests a variance for complete relief from the 2.5’ side setback for driveways and parking spaces set forth in UDO section 2.2.7.F. to allow for after-the-fact permitting of a driveway expansion associated with an existing detached house on a .37-acre property zoned Residential-4 and located at 2724 Dahlgreen Road.
Whereas 1501 New Bern LLC, property owner, requests i) a variance for complete relief from the requirement to provide a Zone A Protective Yard as called for in UDO Section 3.5.3., ii) a 25’ variance for complete relief from service area setbacks set forth in UDO Section 3.5.4.C., and iii) an 8’ variance to the maximum structure height of 60’ at a horizontal distance of 20 feet from the Zone C line as set forth in UDO Section 3.5.5.B.2 to permit up to a maximum of 68′ in structure height (or 4 stories) at a horizontal distance of 20 feet from the Zone C line in association with two proposed 10,000 square foot mixed-use buildings on a 0.55-acre property zoned Commercial Mixed-Use-3-Urban Limited and Transit Overlay District and located at 1501 New Bern Avenue.
The Raleigh Board of Adjustment is a quasi-judicial body that acts on appeals for variances, special exceptions, and interpretations in the zoning regulations. Its decisions are final but may be subject to court action. The Board consists of eight members: four regular members and two alternate members are appointed to two-year terms by the City Council and must reside within the City limits; one regular member and one alternate are appointed by Wake County Commissioners and must reside within the City’s extraterritorial jurisdiction. Established by City Code Section 24-48.
